商品房预售许可程序性规定

行政许可事项名称:商品房预售许可

事项依据：《中华人民共和国城市房地产管理法》

许可期限：10个工作日

是否收费及收费依据：本行政许可事项不收费

许可机关：区县建委（房管局）负责商品房预售许可的受理、初审，市住房城乡建设委负责复审、决定

受理方式：网上填报，书面受理

办理程序：

（一）受理

申请人应先登录北京市房屋交易权属管理系统

（http://s.yingle.com），在线填写预售许可申请信息后，提交以下书面材料：

1、商品房预售许可申请表（原件）；

2、开发企业营业执照副本和资质证书（复印件）；

3、已交付全部土地使用权出让金证明（原件），国有土地使用权证（复印件），出让（转让）合同（经济适用住房项目提交销售价格批准文件和城镇建设用地批准书）（复印件）；

4、建设工程规划许可证（复印件）；

5、建筑工程施工许可证（复印件）；

6、开户银行出具的投入开发建设的资金达到工程建设总投资的25％以上的证明（原件）；

7、招投标管理部门出具的工程施工合同备案表（复印件）和经施工单位确认的施工进度计划；

8、属于绿化隔离带地区的项目，提交市绿化管理部门认可机构出具的确认商品房范围的证明文件（原件）；

9、已将土地使用权或土地使用权连同在建工程设定抵押的，提交抵押权人同意抵押房屋预售的证明（原件）；

10、商品房预售方案，包括：

（1）房屋预售测绘成果备案表（原件）；

（2）房地产开发项目手册；

（3）销售机构和销售人员情况表一式两份（原件）；

（4）2007年3月1日后签订土地出让合同的，或2007年3月1日前已签订土地使用权出让合同但在2007年8月1日后 进行施工招标的住宅项目，还需提交项目建设方案（原件）及建设方案备案登记表（复印件）；

（5）规划管理部门出具的建筑物名称批准文件(复印件)；

（6）《临时管理规约》和《前期物业服务合同》（附电子版）。

上述材料提交复印件的，复印件需加盖申请人印章并同时提交原件，原件核验后退回申请人。

标准：申请材料齐全、符合法定形

岗位职责及权限：

按照受理标准查验申请材料。

符合标准的，予以受理，向申请人出具《受理通知书》，并将申请材料转审查人员。

不符合标准但申请材料存在可以当场更正的错误的，允许申请人当场更正；不能当场更正的，向申请人出具《补正材料通知书》，一次性告知申请人需要补正的全部内容，并将申请材料退回申请人。

申请事项不属于本机关职权范围或者无需取得行政许可的，向申请人出具《不予受理决定书》。

时限：即时

（二）审查

标准：申请人条件符合《北京市城市房地产转让管理办法》（市政府209号令）的规定。

岗位职责及权限：

按照审查标准对受理人员移送的申请材料进行审查。并对拟预售楼栋进行现场勘查，核实现场施工进度，确认施工区域的地上物已全部拆除，制作预售项目现场勘查报告。

符合标准的，签署意见后将申请材料转决定人员（市建委）。

不符合标准的，书面写明审查意见及理由后将申请材料转决定人员（市建委）。

时限：5个工作日

（三）决定

标准：同审查标准

岗位职责及权限：

对行政许可申请作出决定。

同意审查意见的，签署意见，转告知人员（市建委）。

不同意审查意见的，书面提出意见及理由，转告知人员（市建委）。

时限：4个工作日

（四）告知

岗位职责及权限：

对准予许可的，在1个工作日内制作《办理结果通知书》和《商品房预售许可证》，并在10日内将许可证书送达申请人。

对不予许可的，在1个工作日内制作《办理结果通知书》，写明理由和申请人享有的依法申请行政复议或者提起行政诉讼的权利，并将《办理结果通知书》和申请材料退回申请人。

时限：1个工作日（不包括送达期限）
