土地储备制度的起源、演变及挑战
摘要：土地储备制度是我国土地管理制度的一大创新，我国于1996年引进土地储备制度并根据国情进行改善，使之成为我国制度的一大创新。之后，全国土地储备制度发展迅速，各地区不断引进并加以创新。城市土地储备制度是城市土地使用制度改革不断发展完善的成功衍生物，在我国当前经济社会发展中发挥着重大作用。
本文在研究国外土地储备制度的基础上，探析我国土地储备制度借鉴、发展国外土地储备制度的过程；在分析我国现今土地储备制度内容的前提下总结出我国现今土地储备制度对于社会、经济、文化发展的推动作用与重要意义；同时，在归纳总结我国范围内当今土地储备制度运作的三种典型模式的基础上，阐述杭州模式的优越性；再者，立足于实际操作角度系统讲述杭州地区土地储备制度三阶段的具体运作程序与模式；另外，通过分析杭州土地储备制度深入挖掘杭州土地储备制度的现存缺陷与不足，并重点提出完善对策。最后，在研究中共十八届三中全会关于集体经济体制土地制度改革的决定的同时，讨论集体经济土地转让方式的变化对我国现今土地储备制度的影响与挑战。

Abstract: Land reserve system was introduced into China in 1996, when exogenous land reserve system was introduced into Hangzhou in 1997 after first land reserve agency established in Shanghai in 1996. Since then, it took more than ten years to develop and perfect. In June, 1999, Land and Resources announced 《The measures for the implementation of land

acquisition in Hangzhou》. Owing to the restriction and cooperation of laws and regulations, land reserve system developed so fast in nationwide scale and regions kept introducing and innovating. Urban land reserve system is a successful derivative, which results from continuous development and improvement of reform of urban land use system. It plays an essential role in current development of economic society in China.
This paper is focused on analyzing the procedure of learning from foreign land reserve system, based on studying foreign land reserve system; Under the premise of analyzing current land reserve system of our country, this paper summarizes that our country’s current land reserve system has a great promoting and meaning on development of society, economy and culture.
Meanwhile, this paper elaborates the superiority of Hangzhou model in generalizing our country’s current three typical operation models of land reserve system. What’s more, this paper illustrates specific operational procedures and models systematically, of three stages of Hangzhou land reserve system. In addition, this paper comes out a strategy to perfect the system by deeply analyzing the defects and shortcomings of Hangzhou land reserve system. Lastly, while studying the decision of the reform of the land system of collective economy by The eighteen session of the Third Plenary Session of the Communist Party of China, discuss the influences of our country’s current land reserve system caused by the changes of collective economy land transfer mode and come up with issues of development of land

reserve system we may face in the future.

一、 绪论
（一） 国内外土地储备发展与背景 1、 我国土地制度的形成与演变
我国于1996年于引入土地储备制度，并随着同年上海成立的第一家土地储备机构之后杭州也于1997年外生型引入土地储备制度，此后经历了十余年的发展与完善。加之之后的法律法规以及规章制度的规制与协调，全国土地储备制度发展迅速，各地区不断引进并加以创新，而杭州的发展则更为突出。
而我国的土地储备制度，无论是外生型抑或是内生型，都是在西方（主要为荷兰）土地银行基础上衍生出的具有明显我国特点的宏观管理制度。土地储备制度在我国被采用的初衷为支持企业改制，盘活城市有限土地资源，并对有限土地资源进行合理配置；同时，在我国土地所有制的大背景下，将看不见的手与我国实际相结合，童冲新的土地制度规划与安排，刺激经济发展与社会进步。
土地储备管理主体通过主动手段，将有限的可用土地资源进行高效整合、统一协调管理、集中配置，并同时从根本上促进政府部门实现宏观调控目标的实现。
而社会各界对于土地储备制度一向而来的发展意见不一。
2004年，由于土地协议出让制度被废除，招标、拍卖、挂牌成为出让制度的主流。加之日益发展的城市化进程与日益严峻攀升的城市人口密度，与政府对土地市场的以及垄断，土地价格出现畸高现象，而土地储备制度的缺点也逐渐暴露。土地储备制度不再为其初衷——解决国企问题——而服务，却成了部门地方
