医疗鉴定与医疗过错司法鉴定的区别
根据最高人民法院关于参照《医疗事故处理条例》审理医疗纠纷民事案件的通知（以下简称《通知》）：“人民法院在民事审判中，根据当事人的申请或者依职权决定进行医疗事故司法鉴定的，交由条例所规定的医学会组织鉴定。因医疗事故以外的原因引起的其他医疗赔偿纠纷需要进行司法鉴定的，按照《人民法院对外委托司法鉴定管理规定》组织鉴定”。当前存在两种不同性质的鉴定，一是医疗事故技术鉴定，二是医疗过错司法鉴定。由于对《通知》理解的偏差，实际工作中，有的当事人直接要求委托医疗过错司法鉴定；或者，对于医疗事故技术鉴定不构成医疗事故的，不要求再次医疗事故技术鉴定，而是要求进行医疗过错司法鉴定。笔者就如何正确理解《通知》的精神，正确区分医疗事故技术鉴定和司法鉴定，谈一点自己的看法。
1、医疗事故技术鉴定和医疗过错司法鉴定之间的共同点
二者鉴定的核心是一致的，都是围绕医疗机构及其医务人员在医疗活动中是否存在过错以及该过错与人身损害后果之间是否存在因果关系、责任程度进行的鉴定。

２、医疗事故技术鉴定和医疗过错司法鉴定之间的区别
（1）从鉴定的启动次序上看，医疗事故技术鉴定要先于医疗过错司法鉴定，只有经医疗事故技术鉴定不构成医疗事故的才可以进行医疗过错司法鉴定。根据《通知》的精神，最高人民法院民一庭负责人就医疗纠纷处理答记者问时说：“鉴于人身损害赔偿司法解释对赔偿的标准作了一些调整，赔偿的数额比《条例》规定的赔偿数额高，所以因医疗事故受到损害的患者，可能会以一般的医疗纠纷向法院起诉。在这种情况下，如果医疗机构提出不构成一般医疗纠纷的抗辩，并且经鉴定能够证明受害人的损害确实是医疗事故造成的，那么人民法院应当按照《条例》的规定确定赔偿的数额，而不能按照人身损害赔偿司法解释的规定确定赔偿数额”，这里所说的鉴定就是医疗事故技术鉴定，只有经过医疗事故技术鉴定才能确定该纠纷是属于“一般医疗纠纷”还是“医疗事故损害赔偿纠纷”。
（2）从鉴定的委托形式上看，首次医疗事故技术鉴定只能委托当地设区的市级医学会，再次鉴定只能委托所属省的省级医学会；必要时，中华医学会可以组织疑难、复杂并在全国有重大影响的医疗事故争议的技术鉴定工作。医疗事故技术鉴定具有明显的地域性及层级性。而医疗过错司法鉴定不受地域范围的限制，各鉴定机构之间也没有隶属关系。

（3）从鉴定程序上看，医疗事故技术鉴定时，医学会应当根据医疗事故争议所涉及的学科专业，确定专家鉴定组的构成和人数。专家鉴定组进行医疗事故技术鉴定，实行合议制。而司法鉴定是由鉴定机构指定或者选择二名司法鉴定人共同进行鉴定；司法鉴定机构在进行鉴定的过程中，遇有特别复杂、疑难、特殊技术问题的，可以向本机构以外的相关专业领域的专家进行咨询，但最终的鉴定意见应当由本机构的司法鉴定人出具。由于鉴定涉及到25个学科60个专业，医疗事故技术鉴定的程序和办法显然更加科学、更加合理，不但可以保证参加鉴定的成员有一半以上是本专业的专家，而且还可以保证鉴定结论代表了多数人的意见。而司法鉴定机构的鉴定人，并没有要求具备高级技术职称，而且，严格意义上讲，法医学和临床医学是两个不同的领域，司法鉴定人不是临床医师，不具有临床医师的执业资格，不应也不能对临床医学作出鉴定。我国医师法规定，只有具备临床医师资格，并获得临床医师执业证的人才能从事临床医学工作，法医没有临床医师证，又如何能够鉴定临床医疗过错呢？临床医学的复杂性和特定性决定了法医是无法胜任医疗过错鉴定的。
（4）从证据的形式上看，医疗事故技术鉴定书只盖医学会医疗事故技术鉴定专用印章，专家鉴定组成员并不在鉴定书上签字，因此，专家鉴定组成员也不可能出庭接受当事人质询，这是医疗事故技术鉴定书作为证据使用的明显缺陷。而医疗过错司法鉴定实行鉴定人负责
